1. COPYRIGHT AGREEMENT
The education you are about to receive is the intellectual property of Falcon Artistry.
The confidential information shall include, without limitation, any and all trade secrets or information, in any medium, which is known by, made available to, or given to you as a student of Falcon Artistry.
Our training consists of knowledge, practices, trade secrets and property by Falcon Artistry and are not available for duplication in any way. For online courses, we only allow one login session at a time and allow access by one IP address (location).
By choosing "I agree" to the following questions you hereby confirm that you will not use/share the content or information in any or all of the following ways:
⢠Share content, photographs and videos via social media platforms including Twitter, Facebook, Instagram, Linkedin or any other platform, either on your personal on business pages or group forums
⢠Share content with any other person, for any reason
⢠Deliver the content as education to teach others
⢠Recreate any educational material or learning aids. It cannot be downloaded, copied or printed to make any other training program or used in any other way
⢠Copy any colour mixing recipes / charts and pass on to others, either paid or free
⢠Pass on individual ink names used in our mixing charts to help anyone else who isn't a Falcon Artistry student via social media, email, verbally, or visually in any way.

Any breaches of this agreement will result in the strongest legal action.

2. STUDENT AGREEMENTÂ Â

TERMS AND CONDITIONS
In purchasing this Coaching Call (âthe courseâ), you (âthe Studentâ) are agreeing to the outlined terms and conditions of this Agreement (âthe Agreement.â) that has been entered into between yourself and Falcon Artistry. These terms and conditions are part of the contract you enter into when purchasing courses/services from Falcon Artistry and by submitting payment, you are agreeing to them in full. GENERAL
⢠The Contract contains all the terms agreed between the Student and Falcon Artistry and supersedes any discussions or other information previously provided concerning the course/services or workshops.
⢠This Agreement shall be interpreted under the laws of British Columbia, Canada
⢠No terms in this Agreement may be amended or waived unless agreed to in writing by Falcon Artistry.
⢠Falcon Artistry has the right to refuse training or admission to anyone, without the need to provide a reason. In the event that Falcon Artistry refuses training or admission, no formal contract will be entered into and Falcon Artistry will refund payments made.
⢠Neither Falcon Artistry, nor any of its instructors, employees or other agents (the âFalcon Artistry Partiesâ) may be held liable or otherwise responsible for any injury, death or other damage suffered by Student or any individual upon which Student performs any permanent cosmetic procedure, at any time during or after the completion of the Program; and Student shall release, indemnify and hold harmless the Falcon Artistry Parties from any claim or lawsuit arising out of Studentâs participation in the Program or performance of such procedures.
⢠Elements of each course (e.g.: venue, models, speakers, trainers, etc.) may be subject to change without notice. No refunds will be given in the event of any such changes although we will endeavour to notify you, if possible, of the changes.
For the purpose of documentation, marketing, advertisement and educational purposes, students must consent to the taking of photographs and video footage throughout the procedure.
⢠These terms and conditions may be modified and updated at any time, without any notice. You will be subject to the terms and conditions in place at the time of booking and are responsible for reading the current terms and conditions published on our website before booking any further courses. If we are required to make changes to our terms and conditions as a result of law or changes made by the government, the revised terms and conditions will be applicable with immediate effect.
STUDENT REQUIREMENTS
⢠The individual that makes the booking must personally take the course and not be representing another individual. If you are making a gift purchase for a family member or colleague, you agree that you will before the enrolment date, send these terms and conditions to the new student, advising them to read the document in full before training commences, as all outlined points must be agreed and adhered to.
⢠The Student must be 18 years of age or older and must have a good understanding of both written and spoken English, in order to be able to communicate effectively with training models and future clients in a safe and effective manner.
⢠If you have a specific medical requirement or additional learning needs, you must inform us of this prior to the start of your training course.
⢠It is the Student's responsibility to investigate their local licensing and regulations in regards to permanent cosmetics and tattooing. Including by not limited to; apprenticeship, insurance, and other Country Federal/Provincial and local requirements for the practice of tattooing in the area in which they intend to work.
⢠Internet access is required to attend the call.
OVERVIEW
⢠Course descriptions do not form part of our contract between us and you. If training requires flexibility and modifications to suit your specific needs, this will be taken into consideration and adjustments made within reason to accommodate your needs. Should additional expenses (such as a longer call) be required to implement these changes you will be responsible for these and will be notified in advance of them being carried out.
OUTLINE
⢠This course will cover only the subjects outlined in advance between the student and Falcon Artistry.
ATTENDANCE
⢠If students are unable to attend, you must notify us by email at [email protected].
⢠Rescheduling must be done with minimum 72 hours notice
⢠Students are not entitled to a refund if, because of lateness, they miss all or any portion of the course.
⢠Classes start promptly and if you are late will not run over to make up time.
⢠Failure to attend will not be entitle you to a refund.
CONDUCT
⢠Industry codes of conduct and health and safety regulations must be adhered to. If behaviour or conduct is deemed unprofessional, unacceptable or inappropriate, solely at the discretion of the course instructor, the Student will be asked to leave the course. No refund of fees will be made.
⢠Falcon Artistry has the right to remove any Students from the course if, in its sole discretion, the Student is exhibiting behaviour of an intoxicated person or a person under the influence of drugs.
PRIVACY/OWNERSHIP
⢠Beginning the training is an agreement and acknowledgment of the Copyright Agreement for the course.
⢠Falcon Artistry reserves the right to film training sessions and use video and photos for marketing purposes. All recorded likeness and voice captured by video, audio, photographic, digital, electronic, online format or on any and all other media will be used for marketing purposes for courses by Falcon Artistry.
⢠Students agree that such recordings/photos in whatever medium, shall remain the property of Falcon Artistry.
⢠Students are not permitted to use any electronic device during the workshop unless agreed in writing by Falcon Artistry. It is at the instructorâs discretion to allow the use of any electronic device.
⢠Students must not film or record any portion of the course at any time.
⢠Students must not photograph any presentation, illustration, materials used in the workshop.
⢠Students are aware of the fact that manuals, handouts, powerpoint slides, photographs, etc. (collectively known as âFalcon Artistry Training Materials'') are the sole property of Falcon Artistry.
⢠Students are not permitted to copy, sell, publish, redistribute, reproduce, use for training, or provide to a third party in whole or in part any Falcon Artistry Training Materials.
⢠Students can use Falcon Artistry Training Materials solely as a personal reference for the enrolled student only.
⢠Filming the entire training is prohibited for copyright reasons, however you will be permitted to take images of work you have carried out and also audio record certain parts of the training if necessary for your learning needs, under special pre-agreed arrangements. You may take short videos of you working on models.

LIMITATION OF LIABILITY
⢠Students must agree that this course is solely for their personal benefit. Students agree that this workshop does not in any way qualify them to be a trainer.
⢠Neither Falcon Artistry, nor any of its instructors, employees or other agents (the âFalcon Artistry Partyâ) may be held liable or otherwise responsible for any injury, death or other damage suffered by Student or any individual upon which Student performs any tattooing procedure, at any time during or after the completion of the Program; and Student shall release, indemnify and hold harmless the Falcon Artistry Parties from any claim or lawsuit arising out of Studentâs participation in the Program or performance of such procedures.
⢠It is the sole responsibility of the Student to ensure that they have carried out sufficient research regarding available training to suit their specific needs before enrolling in our course. Falcon Artistry takes no responsibility for any claims made against you after you have completed training with us. Students must take full responsibility to follow Canada law, council regulations, health and safety requirements and industry codes of conduct when carrying out procedures on clients. Students take full responsibility for their own work, understand the risks, and undertake further research.
⢠Falcon Artistry takes no responsibility for the Students earnings post course completion. Any information regarding possible income provided by us, is done so in good faith, however we do not guarantee earning potential and do not offer distributorship, training opportunities or specific business development opportunities to increase the Students income.
COMPLAINTS
⢠We take all complaints very seriously and actively encourage honest and constructive communication. If you have a complaint, we will aim to resolve it with immediate effect in person, however should you feel the need to document it, please email us directly at [email protected]. Unless you bring a complaint to our attention, we will be unable to address and resolve it to the best of our ability so please let us know as soon as possible. We do not respond to complaints made via social media and airing opinions in this way will not be tolerated. If you send us a complaint via email, we will aim to respond to you within 7 working days. We will not be liable regarding any claims/complaints raised later than 30 days from the end of the training.

3. PAYMENT TERMS
DEPOSITS & REMAINING BALANCE
⢠Deposits, where payable, are non-refundable and non-transferrable.
⢠Full payment for courses is required upfront before any access is given.
⢠No refunds will be issued under any circumstances.
COURSE TRANSFERS
⢠If you are unable to attend the course, please note: if the future course is a higher fee you will be charged for the additional amount owed. If the cost of the future workshop is lower than the cost of your original workshop, any amount you paid in excess of the substituted workshop will be applied to the balance of the fee due for the substituted workshop.
⢠If an unforeseen emergency circumstance dictates the student must cancel before the first day or during the course, it may be offered to them at a future date. To be considered you must provide a signed written statement as to why you require this, as we do not offer refunds. (See âRemediationâ section.)
CANCELLATION
⢠Falcon Artistry has the right to cancel and reschedule course/workshop at any time, prior to commencement date. In the unlikely event that a workshop is cancelled, Falcon Artistry will notify you as soon as possible and any fees or deposits received from you will be applied to a future workshop date of your choice. Falcon Artistry reserves the right to cancel a workshop at any time prior to commencement. Students agree that Falcon Artistry may cancel a workshop due to adverse weather, dangerous situation, or any other âAct of Godâ beyond Falcon Artistryâs control without prior notice. Please note that Falcon Artistry will not refund any incidental travel or accommodation costs for cancelled courses/workshops.
